Common questions
Do I need a reason to get divorced?
Australia has a no-fault divorce system. To obtain a divorce you need to satisfy the Court that you and your spouse have lived separately and apart for at least 12 months, and there is no reasonable likelihood of resuming married life.
Will our assets be divided equally?
Not necessarily. The Court determines a percentage split in each case by evaluating contributions and the current and future circumstances. Each case turns on its unique factual background.
What is the time limit for property settlement?
If you were married, 12 months from a divorce order becoming final. If you are in a de facto relationship, 2 years from the date of separation.
What am I required to disclose?
You are required to provide full and frank disclosure of all relevant financial circumstances. This duty is broad. Examples include your earnings, interests in property, companies and trusts, financial resources and the past disposal of property.
Can I get divorced if I am still living with my former partner?
Yes, you can obtain a divorce while separated under the same roof.
